1. Acceptance of Terms

By accessing and using the GuardPro LLC website (guardprogutters.com) and any associated services, you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our website or submit any forms.

2. Description of Service

GuardPro LLC is a lead generation intermediary that connects homeowners in Alabama and Oklahoma with licensed local gutter protection installation contractors. We are NOT a gutter installation company ourselves. We do not:

• Directly install gutter systems
• Guarantee pricing from any contractor
• Warrant the quality, licensing, or work of referred contractors
• Act as agent, employee, or representative of any contractor

Actual installation services, warranties, pricing, and contracts are solely between you and the contractor you choose.

3. Eligibility

To use our services, you must:

• Be at least 18 years of age
• Be the homeowner or have authority to authorize home improvements
• Reside in or own property in Alabama or Oklahoma
• Provide accurate and complete contact and property information

4. Free Estimate Service

The "Free Estimate" service means that:

• There is no charge for requesting or receiving an in-home estimate
• Receiving an estimate creates no obligation to purchase any services
• Estimates are non-binding proposals from independent contractors
• Availability is subject to contractor scheduling and geographic coverage
• GuardPro LLC reserves the right to limit free estimate availability at any time

5. Communications Consent (TCPA)

By submitting a form on our website, you acknowledge and agree that:

• You are providing prior express written consent under the TCPA for GuardPro LLC and its named partner contractors to contact you via autodialed calls, prerecorded messages, and SMS/MMS
• This consent is voluntary and not required to receive any service
• You may revoke consent at any time by replying STOP to any text, calling 1-800-555-1234, or emailing optout@guardprogutters.com
• Standard message and data rates may apply to SMS/MMS communications

6. Accuracy of Information

You agree to provide accurate, current, and complete information when submitting forms. GuardPro LLC is not responsible for delays, mismatches, or service failures resulting from inaccurate information you provide. Deliberately false submissions may result in permanent denial of service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. GUARDPRO LLC DOES NOT WARRANT THAT:

• The website will be uninterrupted, error-free, or secure
• Any contractor matched to you will be available, licensed, or qualified
• The quality of any installation work will meet your expectations
• Estimates provided by contractors will be accurate or final

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GUARDPRO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM:

• Your use or inability to use our website or services
• Work performed (or not performed) by any contractor
• Unauthorized access to or alteration of your transmissions or data
• Any other matter relating to the service

Our total aggregate liability shall not exceed $100.00 USD.

9. Indemnification

You agree to indemnify, defend, and hold harmless GuardPro LLC, its officers, directors, employees, agents, and partners from any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorney's fees) arising from your use of the service or violation of these Terms.

10. Intellectual Property

All content on this website — including text, graphics, logos, images, and software — is the property of GuardPro LLC or its licensors and is protected by United States copyright and trademark laws. You may not reproduce, distribute, or create derivative works without express written permission.

11. Prohibited Uses

You agree not to:

• Use our forms to submit false, misleading, or fraudulent information
• Attempt to scrape, crawl, or harvest data from our website
• Use our website for any unlawful purpose
• Interfere with or disrupt the integrity of our website or servers
• Submit multiple requests under false identities ("lead fraud")

12. Third-Party Contractors

Contractors connected through our service are independent third parties, not employees or agents of GuardPro LLC. We conduct basic vetting but do not guarantee the licensing, insurance, workmanship, or conduct of any contractor. You should independently verify contractor credentials before signing any agreement or authorizing work.

13. Advertising Disclosure

GuardPro LLC may receive compensation from contractor partners when a lead is submitted. This does not affect the quality of the matching service or the contractor's pricing to you. All estimates are free and non-binding.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Alabama, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with proceedings conducted in Jefferson County, Alabama.

YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTION LAWSUITS.

15. Changes to Terms

GuardPro LLC reserves the right to modify these Terms at any time. Changes become effective upon posting to this page. Continued use of the service after modifications constitutes acceptance of the updated Terms.
